I am enclosing a cheque for $[amount] which covers my rent arrears and puts me two weeks in advance as required under our tenancy agreement.
As you are aware under sections 89(2) and 89(3) of the Residential Tenancies Act 2010 any action taken to terminate the tenancy for rent arrears cease to have effect if the tenant pays all the rent owing. The NSW Civil and Administrative Tribunal must not make a termination order if the arrears have been paid in full.
I ask that you inform the tribunal that as my rent is now up to date a hearing is no longer required. I will be making every effort to see this situation does not happen again.
A penalty of up to $2200 applies if a landlord fails to notify the tribunal or the Sheriff of repayment of arrears.
